Welcome to Promote My Horse LLP d/b/a PromoteMyHorse.com.
PromoteMyHorse.com referred to as PMH, is formed under the laws of the State of Pennsylvania and provides the service of online promotion of horses, stud services, equine trainers, equine barns, equine shows, and equine shops. PMH is not an agent, broker or dealer of these equine services. PMH does not sell, trade, or lease any horses or equine services.

Indemnity / Release

PMH acts as a venue for horse and equine service promotion. PMH is not involved in the content of or the actual services offered by its advertisers. You agree to indemnify and release PromoteMyHorse.com and its owners, partners, agents, subsidiaries, and employees from any claims, actions, suits, proceedings, expenses, liability, demands and damages (actual or consequential) of every kind and nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, existing or thereafter arising out of or any way connected with any disputes as a proximate result of the content you submit,
post, transmit, or make available through the PMH service, your use of the PMH service, your connection to the PMH service, your violation of the Terms of Service agreement, or violation of any international, federal, state, or local treaty, statute, law and/or regulation relating to your use of the PMH service.

No Guarantee

PMH does not guarantee the promotion of your horse or equine service, nor does it guarantee or warrant the performance of any person or entity advertising on its site. PMH does not insure receipt of purchases or services from any person or entity advertising on its site.

PMH does not control the content posted via its service, and, as such, does not guarantee the accuracy integrity or quality of such content. The advertisers are responsible for proofreading their ads and confirming that the correct photos and content are appearing on their ads.

There is no guarantee of uninterrupted service due to circumstances beyond the control of PMH. You understand and agree that the PMH service is ' AS-IS' and that PMH assumes no responsibility or guarantee for the timeliness, deletion, mis-delivery or failure to store any user content or communications.

There is no guarantee that the PMH service, at any time and from time to time, won’t be modified or discontinued temporarily or permanently, with or without notice. You agree that PMH shall not be liable to you or to any third party for any modification, suspension or discontinuance of the PMH service.

Right to Refuse Service

All advertisement listings are subject to reasonable editorial changes or deletion by PMH.

Slanderous, malicious, warning, or ANY KIND OF DEROGATORY ads are not
Permitted on PMH, and will not be tolerated. Profanity and harassment are not allowed on PMH and will not be tolerated. If found, these ads will be immediately deleted and the user's further access to their account will be suspended or terminated. If you have a complaint or concern about any ad on PMH, please contact us with details. If we suspect or find that an advertiser is participating in any sort of questionable or fraudulent activity via our site, engaging in any false or misleading advertising, etc., PMH will disable the advertiser's account without notice at our own discretion.

Solicitation or spamming of other Promote My Horse users through our site or ads is not allowed, or tolerated.

If you see a slanderous or malicious ad on our site please contact us immediately so action can be taken.

Acknowledgement of Risk

You agree that you have evaluated the risks of using the PMH service, including, but not limited to, misuse of your information by third parties, damage to your computer or
System through the use of the PMH service and bear all risks associated with the use of any content, including any reliance of the accuracy, completeness, or usefulness of such content. As a result, you agree to assume all risks associated with the use of any content.

You acknowledge, consent and agree that PMH may access, preserve, and disclose your account information and content if required to do so by law or PMH reasonably believes in good faith that such access, preservation or disclosure is reasonably necessary to : (a) comply with legal process; (b) enforce the Terms Of Service; (c) respond to claims that any content violates the rights of third-parties; (d) respond to your requests for customer service; or (e) protect the rights, property, or personal safety of PMH, its users and the public.

You understand that the technical processing and transmission of the PMH service, including your content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

You understand that the PMH service and software embodied within the service may include security components that permit digital materials to be protected, and use of these materials is subject to usage rules set by PMH and/or content providers who provide content to the PMH service. You may not attempt to override or circumvent any of the usage rules embedded in to the service. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided on the PMH service, in whole or in part, is strictly prohibited.

PMH is not responsible for photos lost, or damaged in the mail. PMH does not 100% guarantee to return any photos that were received by mailed. PMH is not responsible for typos or accidental errors appearing on advertisements. Photos can be changed by the account owner during any time of their agreed contract with PMH. ALL FEES related to any PMH category of advertising, or any other service is NON REFUNDABLE.

Member Registration Security and Obligations

You will receive a password and account designation upon completing the PMH service registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities, whether authorized by you or not, that occur under your password or account. You agree to (a) immediately notify PMH of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. PMH shall not be liable for any loss or damage arising from your failure to comply with this, including, but not limited to, any unauthorized use.

In consideration of your use of the PMH service, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the PMH registration form and (b) maintain and promptly update this registration data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or PMH has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, PMH has the right to suspend or terminate your account and refuse any and all current or future use of the PMH service (or any portion thereof). When you create a PMH account and allow your child to access the account, you certify that you are at least 18 years old and that you are the legal guardian of the child/children using the PMH account. By allowing a child to use your PMH account, you also give your child permission to access all of the PMH services including, but not limited to, email. Please remember that the service is designed to appeal to a broad audience. Accordingly, as the legal guardian, it is your responsibility to determine whether any of the PMH services and/or content are appropriate for your child.

Privacy

Any personal information posted on Promote My Horse that is misused, PMH is not responsible for. PMH does not, and will never sell your information to Spammers or Junk Mailers.

The PMH service may provide or third parties may provide links to other World Wide Web sites or resources. Because PMH has no control over such sites and resources, you acknowledge and agree that PMH is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that PMH shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

Copyrights, Trademarks, Service Marks, Patents and other proprietary rights

PMH cannot be held responsible for violations created by its viewers or advertisers.
These violations include, but are not limited to: copyright violation, trademark violations, trade names, or patents, or other content which is in violation of any local, state, or federal laws.

Our customers are solely responsible for obtaining express permission from professional photographers, subjects, etc. to display images on our site. We will not accept any images labeled "Proof' for use on our web site. If there is a visible photographer's signature or label on the face of a photo, we will not remove this image. If we are informed of copyright violations created by our customers, we will remove the disputed images from the site without refund or prior notice to the offender. PMH may, in appropriate circumstances and at its own discretion, disable, and/or terminate the accounts of users who have infringed on the copyrights of others. If you are the photographer, please contact your customer directly about their inappropriate use of your photo.

If you believe that your intellectual property has been infringed on our site, please contact and provide PromoteMyHorse.com with the following information:

*A description of the copyrighted work or other intellectual property that you claim has been infringed.
*The advertiser’s name, and location of the ad (ex. Promote M y Horse, Breed M y Horse, etc.)
*Your name, business address, telephone number, and email address.
* A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
* A statement by you, made under penalty of perjury, that the above information in your
Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.
*The signature of the person authorized to act on behalf of the owner of the copyright.

The PromoteMyHorse.com logo, trademarks and service marks and other PMH logos and product and service names are trademarks of Promote My Horse, LLC. Without PMH's prior written permission, you agree not to display or use in any manner, the PMH trademarks.
